Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TRAX CRM platform. By accessing or using the service, you agree to these Terms on behalf of yourself and the facility you represent.
1. Eligibility & Accounts
Access is limited to authorized personnel of subscribing facilities. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
2. Acceptable Use
You agree to use TRAX only for legitimate clinical and operational purposes and in compliance with applicable laws, including HIPAA. You may not attempt to access data belonging to facilities you are not authorized for, reverse engineer the service, or disrupt its security or integrity.
3. Protected Health Information
TRAX acts as a Business Associate to subscribing covered entities. Our handling of PHI is governed by a Business Associate Agreement and the HIPAA Compliance Statement, which are incorporated into these Terms by reference.
4. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, and improvements, and will make reasonable efforts to minimize disruption to clinical workflows.
5. Intellectual Property
The platform, including its software, design, and trademarks, is owned by TRAX. Data you enter remains owned by your facility; you grant us a limited license to process it solely to provide the service.
6. Limitation of Liability
To the maximum extent permitted by law, TRAX is not liable for indirect, incidental, or consequential damages. The platform supports — but does not replace — professional clinical judgment.
7. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to facility administrators, and continued use after changes take effect constitutes acceptance.
